Raleigh County Fire Levy | Commission Motion
At a REGULAR session of the County Commission of Raleigh County, West Virginia, held at the Courthouse thereof on the 20th day of September, 2011 the following Order was made and entered.
SUBJECT: FIRE PROTECTION SERVICES AND EQUIPTMENT ADDITIONAL LEVY FOR FISCAL YEARS BEGINNING JULY 1, 2012, 2013, 2014, 2015 AND 2016.
The following Motion was offered by Commissioner David Tolliver:
The County Commission of the County of Raleigh, West Virginia, being of the opinion that the maximum levies for the current expenses authorized by Article 8, Chapter 11 of the Code of West Virginia, as last amended, will not provide sufficient funds for payment of current expenses of the County, including expenditures for the purpose hereinbefore set forth, and that an election should be held to increase such levies, it is hereby ORDERED:
- That the purpose of which additional funds are needed is as follows:
Fire Protection Services and Equiptment
Expenditures allowed from these funds include: fire station construction, buildings and grounds, maintenance of buildings and grounds, utilities, telephones, television/internet service, insurance of all types, vehicle and maintenance expenses of all types, office equiptment - copiers, computer systems, fax machines and supplies, accounting expenses, training expenses - dues, mileage, meals, and lodging and the construction and maintenance of training areas, purchase of firefighting equiptment - gear, SCBA units and purchase and maintenance, repair of communication equiptment to help the department's strive for NFPA standards.
Expenditures which cannot be made from these funds include: salaries, emergency warning lights or sirens for the use by individual firefighters, dress or parade uniforms, badges or patches for individuals and kitchen appliances.
- That the ammount intended to be generated for the said Fire Protection Services and Equiptment purposes is: $4,000,000.00
- The proceeds from the Fire Levy shall be allocated as follows: the first half of the levy proceeds shall be allocated for use by the individual volunteer fire departments and City of Beckley including a one time equal share allocated to the Emergency Operations Center. The remaining half of the levy proceeds shall be allocated for use by each West Virginia State Certified Volunteer Fire Department of Raleigh County including the City of Beckley on a pro-rata share based upon the assessed value of property within the boundaries of each department. The departments shall not be provided funds from the levy proceeds, however, each department shall submit invoices to the fire coordinator for review and approval to be Paid with the allocated funds.
- The County Commission shall hire a Fire Coordinator to review and determine the appropriate expenditures for each Department. The Coordinator to review and determine the appropriate expenditures for each Department. The Coordinator position shall be funded by the levy proceeds. The Coordinator shall serve at the will and pleasure of the Raleigh County Commission. All expenditures must be approved by the Fire Coordinator. Further, that each Fire Department receiving payments from the funds hereinabove allocated shall be audited annually by an independent certified public accountant approved by the County Commission, the cost of such audit to be borne by the Fire Department, and a copy of each audit report shall be submitted in a timely manner to the County Commission.
- That if for any reason all of the funds hereinabove allocated are not used for the purpose outlined, the unused portion of such funds shall be depositied in an account controlled by the County Fire Coordinator for the benefit of the fire departments. The Fire Coordinator shall select the appropriate allocation for trucks, vehicles and equiptment within the County. The decision shall be at the sole discretion of the Fire Coordinator.
- Beginning the second year of the levy, the Emergency Operations portion of the levy shall be deposited in an account for the purpose of installation of fire hydrants throughout Raleigh County.
- That the seperate and aggrefate assessed valuation of each class of taxable property with the County of Raleigh is as follows:
Class I 4.5 cents Class II 9.0 cents Class III 18.0 cents Class IV 18.0 cents - That the proposed years to which the additional levy shall apply are for the fiscal years beginning, July 1, 2012, 2013, 2014, 2015 and 2016.
- That the County Commission of Raleigh County, West Virginia, will not issue bonds upon approval of the additional levy.
- That the question of such additional levy shall be submitted at the Primary Election to be held on May 1, 2012.
- That notice calling such election shall be given by publication of this ORDER as a Class II-O legal advertisement in compliance with the provisions of Article 3, Chapter 59 of the West Virginia
Code, and the publication area shall be the territory in which the election is held. Such notice shall be so published within fourteen consecutive days next preceding the election. All the provisions of the law concerning general elections shall apply so far as they are practicable, except that a separate ballot shall be used at such election when held in connection with any other election.
- That the ballot to be used at such election shall be in the form as follows:
The ballot shall be entitled "Primary Election to authorize additional levies for the fiscal years 2012, 2013, 2014, 2015 and 2016 and for the purpose of Fire Protection Services and Equiptment according to the Order of the Raleigh County Commission entered on the 20th day of September, 2011."
The additional levy shall be on Class I property four and one half cents (4.5 cents); Class II property nine cents (9 cents); on Class III property eighteen cents (18 cents); on Class IV property eighteen cents (18 cents).
The Motion, having been made by David Tolliver, Commissioner, and duly seconded by Pat Reed, Commissioner, the vote thereon was as follows:
